Welcome to Drive Smart Academy. By booking a lesson or using our services at https://www.drivesmartsd.com, you agree to the following Terms and Conditions.
1. Eligibility
To book and participate in lessons, you must:
Possess a valid learner’s permit or driver’s license and physically have it with you
Be physically and mentally fit to operate a vehicle
Provide accurate and complete information at the time of booking
Failure to meet these requirements will result in cancellation or rescheduling.
2. Booking & Payments
All lessons must be booked in advance through our website or by contacting us directly.
Payment is due at the time of booking unless other arrangements are made in writing.
Prices are subject to change at any time, but confirmed bookings will not be affected.

4. Service Area Policy
If a lesson is booked outside the instructor’s designated service area, we reserve the right to cancel or reschedule the lesson.
We will attempt to notify the customer and offer alternatives if available.
5. Retry Policy (Under 18)
Students under 18 who:
Complete three (3) paid driving lessons with us, and
Fail their first DMV driving test,
are eligible for one (1) free 2-hour lesson to help prepare for a second attempt.
Terms:
Students must follow the schedule recommendations (1st Lesson right away, 2nd Lesson at the halfway point, 3rd lesson the week of the test)
Proof of test failure required
Lesson must be booked within 30 days of the failed test
Offer valid once per student
Complimentary lessons require at least 24 hours’ notice for cancellation or rescheduling.
Cancellations made less than 24 hours before the scheduled lesson or failure to attend will result in forfeiture of the free lesson.
If the student wishes to reschedule a forfeited complimentary lesson, a $60 rebooking fee will be required.
6. Safety & Conduct
Students must follow all instructor directions and drive safely at all times.
Instructors reserve the right to cancel a lesson without refund if a student is under the influence of drugs/alcohol or engages in unsafe, disrespectful, aggressive, or inappropriate behavior behavior.
7. Limitation of Liability
Drive Smart Academy and its instructors are not liable for:
Any damages, losses, or injuries incurred during or after lessons
DMV test outcomes (though we do our best to prepare you)
You agree to assume all responsibility when operating a vehicle under instruction.
8. Changes to Terms
We reserve the right to update these Terms at any time. Updated terms will be posted to our website and effective immediately upon posting.

Welcome to drivesmartsd.com. By accessing or purchasing any course through this website, you agree to the following Terms & Conditions. Please read them carefully before enrolling in any course.
1. Company Information
Drive Smart Academy provides access to online educational driving-related courses, including:
California Driver’s Education
California Traffic Violator School
Mature Driver Insurance Discount Course (55+)
The online course content, platform functionality, certificate processing, and educational materials are provided through our third-party course provider, myimprov.com.
2. Eligibility
By enrolling in a course, you confirm that:
You are at least 13 years of age or have parental/guardian consent where required;
All registration information you provide is accurate and complete;
You meet any eligibility requirements required by the California DMV, courts, or insurance providers.
Certain courses may only be available to California residents or may be intended specifically for California DMV or court requirements.
3. Course Access & Third-Party Provider
Drive Smart Academy acts as a reseller and facilitator of online courses provided through Improv Learning.
All course materials, testing, certificate issuance, technical support, and course functionality are administered by Improv Learning. Drive Smart Academy does not control the course platform, course content, DMV processing times, court processing times, or technical systems operated by Improv Learning.

4. Refund Policy
Customers who are dissatisfied with a course may request a full refund prior to course completion.
Refund requests submitted after a course has been completed, partially completed beyond reasonable use, or after a certificate has been processed or issued may be denied.
Refund eligibility is determined at the sole discretion of Drive Smart Academy and/or Improv Learning.
To request a refund, customers must contact Improv Learning support using the contact information listed above.
5. Certificate Delivery
Driver’s Education Certificates
California Driver’s Education certificates are mailed as required by the California DMV. A downloadable version may also be available depending on course completion requirements and provider availability.
Mature Driver Certificates
Certificates for the Mature Driver Insurance Discount Course may be mailed and/or provided digitally depending on course completion status and applicable requirements.
Traffic Violator School Certificates
Traffic school completion certificates are generally downloadable upon successful completion and may also be electronically submitted to the appropriate California court where applicable.
Standard certificate delivery time is approximately 7–14 business days for mailed certificates.
Expedited shipping options may be available for an additional fee.
Drive Smart Academy is not responsible for delays caused by:
USPS or shipping carriers,
court processing,
DMV processing,
inaccurate shipping information provided by the customer,
or delays caused by Improv Learning systems.
6. User Responsibilities
You agree to:
Use the courses only for lawful purposes;
Provide accurate personal and payment information;
Maintain the confidentiality of your login credentials;
Complete coursework honestly and without impersonation or fraud.
Any misuse, abuse, fraudulent activity, or violation of applicable laws may result in suspension or termination of course access without refund.
7. Intellectual Property
All course content, videos, materials, graphics, quizzes, software, and educational materials are owned by Improv Learning and/or their licensors and are protected by copyright and intellectual property laws.
You may not: reproduce, distribute, copy, modify, resell, or share course materials without written permission.
8. Limitation of Liability
To the fullest extent permitted by California law, Drive Smart Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
course use, inability to access the course, technical interruptions, certificate delays, court rejection, DMV rejection, loss of data, or third-party service failures.
Total liability for any claim related to a course shall not exceed the amount paid by the customer for that course.
9. Arbitration Agreement & Waiver of Class Actions
Any dispute, claim, or controversy arising out of or relating to the use of this website or any course purchased through Drive Smart Academy shall be resolved through binding arbitration in the State of California.
You agree:
to waive the right to file a lawsuit in court,
to waive the right to a jury trial,
and to waive participation in any class action or representative proceeding.
Arbitration shall be conducted under the applicable rules of the American Arbitration Association (AAA).
If any portion of this arbitration provision is found unenforceable, the remaining provisions shall remain in full force and effect.

Your use of this website is also governed by our Privacy Policy.
By using this website, you consent to the collection and use of information as described in the Privacy Policy.
11. Changes to Terms
Drive Smart Academy reserves the right to modify or update these Terms & Conditions at any time without prior notice.
